Guidelines for selling assets trough NTB

Guidelines for selling assets trough NTB

1. Always consider privacy before posting photos of people who do not have a public role

Everyone has the right to their own image. This applies regardless of whether the use is editorial or commercial. The right to one's own image is primarily regulated by Section 104 of the Norwegian Copyright Act.

As a general rule, a photograph depicting a person cannot be reproduced or displayed publicly without the consent of the person depicted. Therefore, always ensure that you get written permission from the person in the photo when you post this type of photo.

Model-certified images from Norwegian contexts/environments are in high demand by our customers. Basically, everyone in the picture must be model-certified, including less obvious people in the background.

If you are taking photos where there are many people in the background, it is a good idea to get close to the subject and adjust the depth of field as much as possible.

The Copyright Act allows for a few exceptions when it comes to the right to one's own image, including:

  • when the depiction is current and of general interest
  • when the image depicts gatherings, public processions in the open air or conditions or events of general interest
  • in police investigations
  • under certain conditions in scientific texts and biographies

Privacy applies for the lifetime of the person pictured and 15 years after the end of the person's year of death.

2. NTB has both editorial and commercial users in the image portal

Please note that the images in NTB's image portal are used by both editorial and commercial players.

Commercial use can be:

  • in social media
  • on a website or intranet
  • for content marketing
  • in a presentation
  • on posters, brochures, catalogs or other shop or marketing material
  • in communication such as newsletters, programmes, invitations, e-mails
  • as decoration or hanging in offices, hotels etc.
  • in advertising or advertisements
  • on product packaging

Images that shouldn't be used in a commercial context should be marked editorial use only in the field Right usage terms / Instructions. Please note that it’s never guaranteed that the end user reads all metadata fields.
